Legislation Update: New Oaths and Affirmations Act 2018 (Vic)
The Oaths and Affirmations Act 2018 (Vic) (the Act) came into effect on 1 March 2019.
This new stand-alone Act contains provisions relating to oaths, affirmations, affidavits and statutory declarations, and replaces a number of provisions from the Evidence (Miscellaneous Provisions) Act 1958. Reference should be made in particular to sections 23, 25 and 26 of the Act which outline the relevant changes to affidavits and exhibits going forward.
The Act also sets out a clear certification scheme that may be used by an authorised certifier to certify a copy of an original document as a true copy.
